Acceptable Use Policy

This policy sets the rules for using Hubify Solutions Inc. products, platforms, and services, and applies in particular to business messaging we operate on a client's behalf — including messaging through the WhatsApp Business Platform and comparable channels. It forms part of our Terms of Service. It exists to keep our clients, their customers, and our platform partners safe, and to keep everyone on the right side of the rules the platforms enforce.

01Who this applies to

This policy applies to every client, user, and partner who uses our products or services, and to anyone acting on their behalf. If you instruct us to send messages, run automation, or process data for you, you are responsible for ensuring that your use — and the use made by your staff, agencies, and contractors — complies with this policy.

03Honouring opt-outs

You must process opt-out requests promptly and permanently, including replies such as STOP, UNSUBSCRIBE, or an equivalent in the recipient's language, and any request made in ordinary words. Opt-outs must be honoured across the channel concerned regardless of which of your teams or systems the request reaches. You must not require a recipient to justify an opt-out, add unnecessary steps, or re-add them to a list without a fresh opt-in.

04Prohibited content and conduct

You must not use our services to send or facilitate: unlawful, fraudulent, deceptive, or misleading content; spam or unsolicited bulk messaging; harassment, threats, hate speech, or content inciting violence; sexually explicit material or content exploiting minors; malware, phishing, or credential harvesting; content infringing intellectual property or privacy rights; misinformation designed to cause harm; or anything prohibited by the messaging policies of the platform in use, including Meta's WhatsApp Business Messaging Policy and WhatsApp Commerce Policy where that platform is involved.

05Restricted goods and services

Messaging platforms prohibit or restrict promotion of certain categories, which commonly include illegal or recreational drugs, tobacco and vaping products, alcohol in some markets, weapons and ammunition, gambling, adult products and services, dangerous supplements, live animals, human body parts and fluids, medical and healthcare products in some markets, and unlicensed financial or cryptocurrency offerings. You are responsible for confirming that what you promote is permitted on the platform and in every market you send to, and we may decline or stop work that falls into a prohibited category.

06Technical and platform integrity

You must not attempt to circumvent rate limits, quality ratings, template review, or other platform controls; operate multiple accounts to evade a restriction or ban; misrepresent your identity or your business; interfere with the operation of our systems or any platform; probe, scan, or test the vulnerability of a system without our written permission; or resell, sublicense, or provide access to our services to a third party without our written agreement.

07Message quality

Messaging platforms measure quality through recipient blocks and reports, and a poor rating can reduce your sending limits or suspend your number. You are expected to message only recipients who expect to hear from you, keep frequency reasonable, make the purpose of each message clear, provide a genuine way to reach a human, and act on feedback signals. We will flag quality problems where we see them, but the sending behaviour and its consequences are yours.

08Data protection obligations

You must provide the notices and obtain the consents required by law from the individuals whose data you ask us to process, keep the data you supply accurate and lawfully obtained, respond to data subject requests relating to your data, and not send us sensitive categories of personal information — such as health, biometric, financial account, or government identifier data — unless we have agreed in writing that a service will handle it.

09Enforcement

If we become aware of a breach we may ask you to correct it, throttle or suspend the affected service, or terminate the engagement, depending on severity and risk. We may act immediately and without prior notice where the breach is serious, where it exposes recipients to harm, or where a platform provider or a regulator requires it. We will tell you what happened and, where the issue can be corrected, what is needed to restore service. Serious or repeated breaches may be reported to the relevant platform provider or authority where we are required to do so.

10Reporting abuse

If you have received a message you believe was sent in breach of this policy through a service we operate, tell us at [email protected] with the sending business name and, where you can, the phone number or address involved and the date. We investigate every report, act with the client concerned, and will confirm the outcome to you where we are able to.

11Changes to this policy

We may update this policy as platform rules and applicable law change. The effective date at the top of this page reflects the current version, and we will notify active clients of material changes.
